Examples of Distracted Driving

April is Distracted Driving Awareness Month. Are you a safe driver? Now would be a good time to reflect and make sure.

What is Distracted Driving?

Distracted driving is anything that diverts attention from the act of operating the vehicle. This can include visual distractions like billboards or turning to talk to a passenger; manual distractions like adjusting the radio or eating; and cognitive distractions like daydreaming or mentally planning out your day.

Some things, like cellphone use, involve all three types of distraction. This is one of the primary reasons it is illegal to use a cellphone while driving in New York State. Unless, of course, that cellphone is hands-free. This, however, is a false sense of security. While not illegal, studies have found that hands-free and voice-activated devices pose a higher distraction risk than handheld cellphones and tablets.

What to do When Injured by a Distracted Driver

When you're involved in an accident caused by a distracted driver, it is important that you take steps to protect yourself.

If possible, try to document the scene by taking pictures. Gather contact information from any witnesses and be sure to get the driver’s license number, insurance information, and contact information of any involved drivers.

You will want to see a doctor as soon as possible after your accident. Even if your injuries seem minor, it is a good idea to have a physician examine your internal organs and brain to help identify any damage that has been done.

If you have sustained a serious injury, it is important to have an attorney on your side right away. Distraction is not always identified as a factor in accidents. Your attorney will investigate the circumstances surrounding yours to determine if inattention played a role.

And remember, it is not always possible to take action on the scene of an accident. If your injury was too severe for you to take pictures and gather information, your lawyer will gather as much information as possible while building your claim.
