Section 241 of the New York Labor Law provides safety and protection to construction professionals working onsite. In particular, it provides strict safety requirements that contractors, owners and their agents must follow when constructing, excavating or demolishing buildings. Owners of one- or two-family homes who do not direct the construction work are exempt from liability under Section 241.
Similar to Section 240 of the New York Labor Law, Section 241 imposes strict liability on owners and contractors who fail to provide adequate safety measures during construction. This means that the owner may be held liable for total compensatory damages to the injured worker, regardless of whether the worker was largely at fault for the accident. Even if a contractor or owner was 1 percent at fault, the injured worker will be able to claim total compensatory damages for his or her injuries.
